Terms of Service

Overview

These terms apply when you engage Nathan Tong (ABN 17 825 183 044) for web design, SEO consulting, Google Business Profile management, or ongoing maintenance retainer services. By engaging my services, you agree to these terms.

Services provided

I offer the following services to small businesses:

  • Website design and build
  • SEO consulting and local SEO
  • Google Business Profile setup and optimisation
  • Ongoing website maintenance and monthly SEO retainers

The specific scope of work for your project will be agreed in writing before any work begins, either via email or a formal proposal.

No lock-in contracts

There are no lock-in contracts on any of my services. One-off projects (website builds, SEO setups) are scoped and priced upfront. Monthly retainers can be cancelled at any time with 30 days' written notice.

Payment terms

For one-off projects, payment is typically split into two instalments: 50% upfront to begin work, and 50% on completion before handover. For monthly retainers, invoices are issued at the start of each month and are due within 14 days.

All prices are quoted in Australian dollars and are inclusive of GST where applicable.

Cancellation

For monthly retainers, you can cancel at any time by giving 30 days' written notice via email. You'll only be billed for the current month and any work already completed. For one-off projects, if you need to cancel after work has started, you'll be invoiced for the work completed up to that point.

Ownership of content and assets

You own all content, copy, images, and other assets you provide for your project. Once a project is completed and paid in full, you own the finished website, including the code, design, domain, and hosting account. I don't hold anything hostage.

Portfolio use

I reserve the right to display completed work in my portfolio and on my website for promotional purposes, unless you specifically request otherwise. Just let me know and I'll keep your project private. No questions asked.

Limitation of liability

I'll always do my best to deliver quality work, but I can't guarantee specific search engine rankings, traffic increases, or business outcomes. SEO results depend on many factors outside my control, including Google's algorithms, your competitors, and your industry.

My liability for any claim arising from my services is limited to the total amount you've paid me in the 12 months prior to the claim. I'm not liable for any indirect or consequential losses.

Your responsibilities

To do my best work, I'll need you to:

  • Provide content, images, and feedback in a timely manner
  • Ensure any content you provide is accurate and you have the right to use it
  • Provide access to any accounts or platforms I need (hosting, domain, Google Business Profile, etc.)

Governing law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

Changes to these terms

I may update these terms from time to time. Any changes will be reflected by updating the date at the top of this page. If you're on an active retainer, I'll let you know about any changes that affect our arrangement.
